Allahabad HC junks plea against UPPSC quota policy

The Allahabad High Court on Thursday disposed of the petition filed by the job aspirants challenging the reservation policy of the Uttar Pradesh Public Service Commission (UPPSC) on the ground that the relief sought by the petitioners had already been granted to them by the commission.

The petitioners had alleged that the policy was discriminatory towards the general category candidates.

While disposing of the petition, a Division Bench of Justices Laxmi Kanta Mohapatra and Rakesh Srivastava took note of the supplementary affidavit filed by the UPPSC, in which it was said that the decision and the result under challenge had been withdrawn.

The petitioners had wanted quashing of the result of the UPPCS (Mains)-2011 that was declared on July 4 according to the new policy. They had also wanted that the May 27 decision of the UP PSC, which led to the change in the reservation policy, be quashed.

"Since the UPPSC has withdrawn both, there were no legal issues left to be decided by the court,'' said Santosh Kumar Srivastava, counsel for petitioners Sudhir Kumar Singh and six others.

Earlier, the Bench had reserved judgment on the matter on July 22. It had also prevented the UPPSC from going ahead with the interview on the basis of the UP PCS (Mains)-2011 results. The supplementary affidavit was filed by the UPPSC on July 30.

The change in UPPSC decision was preceded by a delegation of anti-reservation job aspirants meeting the Samajwadi Party supremo Mulayam Singh Yadav on July 26.

The anti-reservation job aspirants had earlier gone on the rampage on July 15, and then again on July 22, demanding withdrawal of the UPPSC policy.

Following the withdrawal of the decision by the UPPSC, the pro-reservation aspirants had gone on the offensive attacking the house of the SP's district president as well as the party office here. A delegation also met the UP Chief Minister Akhilesh Yadav in Lucknow Wednesday. The talks, however, were "futile''.
